Terms of Service

These Terms of Service ("Terms") govern your use of the Predictive Outdoors mobile application and predictiveoutdoors.com (the "Service"), operated by Predictive Outdoors, LLC ("we," "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.

// READ THIS FIRST The safety check-in feature is an additional tool, not a substitute for telling a real human where you're hunting and when you'll be back. The hunt predictions are advisory, not guarantees. Section 6 and Section 7 explain. If you skip them, you've still agreed to them.

1. Eligibility

You must be at least 13 years old to create an account. Hunters under 13 may use the Service only through a parent's or guardian's account, under that parent's or guardian's supervision. We don't allow children under 13 to have their own accounts or knowingly collect personal information from them, and if we learn we have, we delete it. By creating an account, you represent that you meet these requirements.

You must comply with all hunting laws, license requirements, season dates, weapon restrictions, bag limits, and land-use rules that apply where you hunt. Compliance is your responsibility, not ours.

2. Your Account

You're responsible for everything that happens under your account, including keeping your password secure.
Notify us at support@predictiveoutdoors.com immediately if you suspect unauthorized use.
You may delete your account at any time from the Profile screen. See our Privacy Policy for what gets deleted and when.

3. Acceptable Use and Community Rules

You agree not to:

Use the Service for any illegal activity, including unlawful hunting, poaching, trespassing, or violations of wildlife regulations.
Post false sighting data, harass other users, send spam in club chat, or upload copyrighted content you don't own.
Attempt to access another user's account, reverse-engineer the Service, or interfere with its operation (DDoS, scraping, automated bot traffic).
Resell, sublicense, or commercially redistribute the Service without our written permission.
Use the Service to track another person without their consent.

Zero tolerance for objectionable content or abusive users. Don't post anything harassing, threatening, hateful, sexually explicit, graphically violent, or that shares someone else's private information (including their stands, gate codes, or location) without their permission.

Reporting and blocking. You can report any message or sighting, and block any user, from inside the app (long-press a message, or tap ⋯ on a sighting). Blocking hides that person's posts from you and stops direct messages both ways. We review reports, usually within 24 hours, and may remove content, remove users from a camp, or suspend or ban accounts. You can also email support@predictiveoutdoors.com. Camp owners and admins can remove messages in their camp channel and remove members.

We may suspend or terminate accounts that violate these rules.

4. Your Content

You retain ownership of the content you submit — sightings, photos, messages, hunt notes. By submitting content, you grant us a worldwide, royalty-free, non-exclusive license to store, display, process, and transmit it solely to operate and improve the Service (including the area sighting feed, club chat, and aggregated analytics).

We may use anonymized, aggregated data — counts, regional patterns, behavioral trends — for research and to improve predictions. Aggregated data cannot be tied back to you or your specific locations.

You're responsible for the content you submit and for ensuring you have the right to submit it.

5. Fees

The app is currently free and has no in-app purchases or subscriptions. If we add paid features, we'll update these Terms and show the price and renewal terms in the app before you buy. Any purchases would be billed through Apple's App Store or Google Play, and refunds would follow their policies.

6. Predictions Are Advisory

// IMPORTANT

Hunt scores, solunar predictions, wind and air-flow visualizations, weather forecasts, and any other predictive output from the Service are advisory only.

Wildlife behavior is variable and influenced by factors we cannot model. We make no guarantee that game will be present, active, or behave as predicted. The Service is a tool to inform your decisions, not a replacement for field experience, scouting, or judgment. Outcomes — successful hunts, missed opportunities, equipment decisions made based on the Service — are your responsibility.

Weather forecasts are sourced from third parties and are subject to their accuracy and availability. Map and parcel data are sourced from third parties and may be incomplete, outdated, or inaccurate.

7. Safety Check-In — Important Limitations

// IMPORTANT

The Safety Check-In feature lets you set the time you expect to be out and shows members of your camp, inside the app, when you are overdue. If you miss your check-out, the Service may also send text-message (SMS) alerts to you, your camp and emergency contacts who have confirmed by replying YES; the program terms are in Section 8. Safety Check-In is a backup tool, not an emergency response system.

By using Safety Check-In you acknowledge that:

Cell signal may be unavailable in the field. The app cannot check you in, send an alert, or update your location without a working signal.
Alerts are best-effort. In-app alerts depend on your camp members having the app and a signal. Once text alerts are active, SMS delivery will depend on our SMS provider (Twilio), your recipient's carrier, the recipient's phone state, and other factors outside our control. We do not guarantee delivery, timing, or that the recipient will see and act on the message.
This is not 911. In an emergency, call 911 or your local emergency services directly. The Service is not an emergency response platform and does not contact public safety agencies on your behalf.
You should always tell a real person — independently of this app — where you're hunting and when you expect to return. Treat the Safety Check-In as an additional layer, not a primary plan.
Emergency contacts are your responsibility. You're responsible for ensuring the numbers you provide are accurate, monitored, and that the people you designate know what to do if they receive an alert.

We are not liable for any loss, injury, delay, or damage resulting from missed, delayed, undelivered, or ignored safety alerts.

8. Text Message (SMS) Program

These terms apply to the Predictive Outdoors Safety Alerts text program, run by Predictive Outdoors, LLC. Plain-language details and example messages are at predictiveoutdoors.com/sms. Status: the program is live.

What we send. Hunt safety texts only: check-out reminders to a hunter who opted in, overdue safety alerts to that hunter's confirmed emergency contacts and to camp owners or admins who opted in, a one-time confirmation request to a newly added emergency contact, all-clear notices, and replies to HELP, STOP and START. We don't send marketing or promotional texts.
How you opt in. Hunters opt in by ticking Text me safety alerts in the app (Me tab or setup). An emergency contact is texted only after the hunter confirms the contact agreed, and the contact replies YES to our confirmation text. Consent is not a condition of using the Service or of any purchase.
Message frequency varies. Texts are only sent around hunts a user checks in to, usually 1 to 3 per hunt; alerts go out only if a check-out is missed.
Msg & data rates may apply. We don't charge for texts, but your carrier's messaging and data rates apply.
Opting out. Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT) to any message. We'll send one confirmation and no further texts. Reply START to opt back in. Hunters can also untick the box in the app.
Help. Reply HELP, or email support@predictiveoutdoors.com.
Your responsibilities. Only add an emergency contact whose number you're allowed to give us and who has agreed to get these texts. Keep your numbers current, and tell us (or remove the number) if you give up a phone number.
Delivery. Carriers are not liable for delayed or undelivered messages. Delivery depends on coverage, the recipient's carrier and phone, and our SMS provider (Twilio). Section 7 applies: texts are a backup, not an emergency service. In an emergency, call 911.
Privacy. We don't sell, rent, or share mobile numbers or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy.
Changes. We may change or end the program. We'll update these Terms and, for material changes, tell you in the app or by text before they take effect.

9. Property, Stand, and Parcel Data

Parcel and property data shown in the Service is provided for informational purposes only. We do not guarantee accuracy, currency, or completeness. Before hunting on any property:

Confirm you have legal permission from the landowner or appropriate authority.
Confirm property boundaries against authoritative sources (county records, recent surveys).
Confirm legal hunting status with your state wildlife agency.

Using the Service does not grant you any right to enter, hunt on, or otherwise use any property. Trespass is your responsibility, not ours.

10. Firearms and Equipment

The Service does not sell, ship, broker, or facilitate the transaction of firearms, ammunition, or regulated equipment. Any references to weapons, calibers, or hunting methods are informational only.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDICTIVE OUTDOORS, LLC, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING BUT NOT LIMITED TO MISSED OR DELAYED SAFETY ALERTS, INACCURATE PREDICTIONS, INACCURATE PROPERTY OR PARCEL DATA, OR UNSUCCESSFUL HUNTS.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Predictive Outdoors, LLC and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

14. Termination

You may stop using the Service at any time and delete your account from the Profile screen. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice. Sections that by their nature should survive termination (ownership, warranty disclaimer, limitation of liability, indemnification, governing law, dispute resolution) will survive.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles.

16. Dispute Resolution and Arbitration

Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by contacting support@predictiveoutdoors.com. We'll try to resolve the dispute within 60 days.

Binding arbitration. If informal resolution fails, any dispute arising from or related to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be held in Fulton County, Georgia, or remotely. The arbitrator's decision is final. Either party may seek injunctive relief in court for intellectual property infringement.

Class action waiver. You and we agree that disputes will be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.

30-day opt-out. You may opt out of the arbitration and class action waiver provisions in this Section by emailing support@predictiveoutdoors.com within 30 days of first accepting these Terms, with your name and a clear statement that you wish to opt out.

17. Changes to These Terms

We may update these Terms. We'll change the "Last updated" date and, for material changes, give reasonable advance notice through the app or by email. Continued use after the effective date means you accept the changes. If you don't accept, stop using the Service and delete your account.
