Terms of Service
These Terms of Service ("Terms") govern your use of the Predictive Outdoors mobile application and predictiveoutdoors.com (the "Service"), operated by Predictive Outdoors, LLC ("we," "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.
1. Eligibility
You must be at least 18 years old to create an account, or at least 13 with verifiable parental or guardian consent. By creating an account, you represent that you meet these requirements.
You must comply with all hunting laws, license requirements, season dates, weapon restrictions, bag limits, and land-use rules that apply where you hunt. Compliance is your responsibility, not ours.
2. Your Account
- You're responsible for everything that happens under your account, including keeping your password secure.
- Notify us at support@predictiveoutdoors.com immediately if you suspect unauthorized use.
- You may delete your account at any time from the Profile screen. See our Privacy Policy for what gets deleted and when.
3. Acceptable Use
You agree not to:
- Use the Service for any illegal activity, including unlawful hunting, poaching, trespassing, or violations of wildlife regulations.
- Post false sighting data, harass other users, send spam in club chat, or upload copyrighted content you don't own.
- Attempt to access another user's account, reverse-engineer the Service, or interfere with its operation (DDoS, scraping, automated bot traffic).
- Resell, sublicense, or commercially redistribute the Service without our written permission.
- Use the Service to track another person without their consent.
We may suspend or terminate accounts that violate these rules.
4. Your Content
You retain ownership of the content you submit — sightings, photos, messages, hunt notes. By submitting content, you grant us a worldwide, royalty-free, non-exclusive license to store, display, process, and transmit it solely to operate and improve the Service (including the area sighting feed, club chat, and aggregated analytics).
We may use anonymized, aggregated data — counts, regional patterns, behavioral trends — for research and to improve predictions. Aggregated data cannot be tied back to you or your specific locations.
You're responsible for the content you submit and for ensuring you have the right to submit it.
5. Subscriptions and Payments
Some features may require a paid subscription. Subscriptions are billed through Apple's App Store or Google Play and auto-renew unless canceled at least 24 hours before the end of the current period. Manage or cancel from your App Store or Google Play account settings.
Refunds are handled by Apple or Google per their respective policies. Pricing and feature availability may change; we'll give reasonable notice before changes affect existing subscribers.
6. Predictions Are Advisory
Hunt scores, solunar predictions, scent cone visualizations, weather forecasts, and any other predictive output from the Service are advisory only.
Wildlife behavior is variable and influenced by factors we cannot model. We make no guarantee that game will be present, active, or behave as predicted. The Service is a tool to inform your decisions, not a replacement for field experience, scouting, or judgment. Outcomes — successful hunts, missed opportunities, equipment decisions made based on the Service — are your responsibility.
Weather forecasts are sourced from third parties and are subject to their accuracy and availability. Map and parcel data are sourced from third parties and may be incomplete, outdated, or inaccurate.
7. Safety Check-In — Important Limitations
The Safety Check-In feature sends an SMS to the emergency contacts you configure if you don't confirm safe by the time you set. It is a backup tool, not an emergency response system.
By using Safety Check-In you acknowledge that:
- Cell signal may be unavailable in the field. The app cannot check you in, send an alert, or update your location without a working signal.
- SMS delivery is best-effort. Delivery depends on Twilio, your recipient's carrier, the recipient's phone state, and other factors outside our control. We do not guarantee delivery, timing, or that the recipient will see and act on the message.
- This is not 911. In an emergency, call 911 or your local emergency services directly. The Service is not an emergency response platform and does not contact public safety agencies on your behalf.
- You should always tell a real person — independently of this app — where you're hunting and when you expect to return. Treat the Safety Check-In as an additional layer, not a primary plan.
- Emergency contacts are your responsibility. You're responsible for ensuring the numbers you provide are accurate, monitored, and that the people you designate know what to do if they receive an alert.
We are not liable for any loss, injury, delay, or damage resulting from missed, delayed, undelivered, or ignored safety alerts.
8. Property, Stand, and Parcel Data
Parcel and property data shown in the Service is provided for informational purposes only. We do not guarantee accuracy, currency, or completeness. Before hunting on any property:
- Confirm you have legal permission from the landowner or appropriate authority.
- Confirm property boundaries against authoritative sources (county records, recent surveys).
- Confirm legal hunting status with your state wildlife agency.
Using the Service does not grant you any right to enter, hunt on, or otherwise use any property. Trespass is your responsibility, not ours.
9. Firearms and Equipment
The Service does not sell, ship, broker, or facilitate the transaction of firearms, ammunition, or regulated equipment. Any references to weapons, calibers, or hunting methods are informational only.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDICTIVE OUTDOORS, LLC, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING BUT NOT LIMITED TO MISSED OR DELAYED SAFETY ALERTS, INACCURATE PREDICTIONS, INACCURATE PROPERTY OR PARCEL DATA, OR UNSUCCESSFUL HUNTS.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless Predictive Outdoors, LLC and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.
13. Termination
You may stop using the Service at any time and delete your account from the Profile screen. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion, with or without notice. Sections that by their nature should survive termination (ownership, warranty disclaimer, limitation of liability, indemnification, governing law, dispute resolution) will survive.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-law principles.
15. Dispute Resolution and Arbitration
Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by contacting legal@predictiveoutdoors.com. We'll try to resolve the dispute within 60 days.
Binding arbitration. If informal resolution fails, any dispute arising from or related to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be held in Fulton County, Georgia, or remotely. The arbitrator's decision is final. Either party may seek injunctive relief in court for intellectual property infringement.
Class action waiver. You and we agree that disputes will be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.
30-day opt-out. You may opt out of the arbitration and class action waiver provisions in this Section by emailing legal@predictiveoutdoors.com within 30 days of first accepting these Terms, with your name and a clear statement that you wish to opt out.
16. Changes to These Terms
We may update these Terms. We'll change the "Last updated" date and, for material changes, give reasonable advance notice through the app or by email. Continued use after the effective date means you accept the changes. If you don't accept, stop using the Service and delete your account.
